Immigration this holiday season

The holiday season is almost upon us. This is a wonderful time of the year that provides us a great opportunity to reflect on everything we have and to spend time with friends and family. Those who we care about most are obviously those who should be with us during such an important time of the year. Unfortunately, many people are unable to be together during this time of the year due to immigration issues. For everyone who finds themselves in that situation, it can be a very difficult and emotional time. For many immigrant families it has been years since they have seen family in their home country, and because of their immigration status it is simply not an option to travel and be with them, or for their family members to come to the U.S. Many people came to see us at the beginning of 2014, determined to be home with family or have family here with them by Christmas.
We are hopeful that immigration reform or an executive order happens soon that will allow many people to reunite with their family. However, there is quite simply no way of knowing what will happen with immigration reform and when any of those benefits will be available. For those of you who may be able to qualify for any type of benefit immediately and have simply not taken the time to apply because of money, time, or any other reason, do not wait any longer. Do not miss out on spending the Holidays with family next year waiting for immigration laws to change; begin working on your status immediately so that you can spend Christmas next year with your family. Now is the perfect time to investigate what type of benefit you may be able to qualify for.
Many people qualify for the new 601A waiver which allows people to obtain the waiver inside the United States without waiting for extended amounts of time outside of the US. However, few people have applied for it because of financial considerations, fear of being unable to return or other reasons. This is an amazing benefit that many people are missing out on. We have watched as our clients are able to receive approval of this waiver and be home with their families this year. To see the joy and excitement on their face as they prepare to see people they have not seen in some cases over 20 years is very special. Immigration processes can be long and difficult, and some can require upwards of a full year or more.
Others may qualify for any number of other immigration benefits, such as adjustment of status, U-visa, VAWA, etc. Those with Deferred Action for Childhood Arrivals (“DACA”) can solicit Advance Parole under certain circumstances, which allows them to reenter the U.S. after travel abroad. This is an amazing benefit and we have helped many of our clients obtain it. However, be mindful that DACA does not allow travel outside of the U.S. unless the Advance Parole is approved prior to departing the U.S. Always consult with an experienced immigration attorney prior to considering any travel.
