Debt relief for divorced mom; Obama amnesty for adult child

CHAPTER 7 RELIEF FOR DIVORCED MOM
Client is 48 years old and works as an accountant for a business. Her salary is $60,000 a month. Her marriage ended two years ago when she found out that her husband of 15 years had another family in another city. Husband had a 10-year old son with another woman that he kept on the side. In fact, the mistress knew that he was married but the fact that he was married did not make any difference to the mistress. I guess that’s why she’s the mistress. Husband had secretly kept another bank account, unknown to client, that he placed a portion of his income in every month for the expenses of his mistress and his illegitimate son. Since husband was a dentist and had his own clinic, it was easy for him to expense that income out of his dental practice, through creative ways such that even though client and husband were filing joint tax returns since they were married, client was utterly clueless that she had married an utterly unfaithful fraud. Being of sound mind, but an emotional wreck nonetheless because of her husband’s betrayal, client decided to start a new life as a single mom, got a divorce for her self respect and took custody of their son who was about to start high school.
With the divorce, client has suffered a large reduction in household income since her husband contributed at least $80,000 to the household income, which has disappeared. In addition, client is left to handle on her own, close to a $100,000 of unsecured debt, mostly credit card debt, a $2500 mortgage, and two car payments. With son going to a private high school and with so many extracurricular activities, client feels that she can no longer afford to pay $3,000 a month for credit card debt, otherwise, she will default on her mortgage and two car payments. So, client decides to get rid of all her credit card debt with a Chapter 7 bankruptcy. The bankruptcy will discharge all of the $100,000 of credit card debt, allowing her to take care of her mortgage, car payments and the rest of her monthly expenses in her new life as a divorced single mom. She gets to keep her house, her cars, even her 401K, and everything else that she owns. Her credit score will improve every year as long as she timely pays her mortgage, car payments and the new credit cards that she will receive after discharge. On the 2nd year after discharge, her credit score will be over 600, on the third year, it will be at least 640.
Adult child seeks Obama amnesty
Client is now 30 years old. He is still living in the shadows of the American dream even though he has now lived in Los Angeles for 12 years. She was brought to America first by his mother when he was 18 years old. Mom had annulled her marriage to her husband in their country of origin and she came to America with his mom on B1 visa. Mom is beautiful so had no problem attracting many suitors here. A senior American who is still in good health and still able to enjoy life, whose wife passed away 4 years ago after 40 years of marriage, fell in love with mom, head over heals, and eventually proposed marriage. Mom accepted and eventually mom became a permanent resident and a U.S. citizen. Mom is doing well and working. Husband is so happy with his new wife and he gives her everything she wants. They travel all over the world. Husband even buys her a new house in her country of origin. Mom is fortunate to find this man who truly loves her, and this man is truly happy to have her as his new wife. He says he is lucky to be in love again when he though it was not possible for him to fall in love again.
But son, who is now 30 years old, is left in limbo. Sure, mom can petition him for an immigrant visa but he will have to wait 20 years to get that visa. In the meantime, he is now a young adult at his prime but is not able to work because he cannot legalize his status. Son will qualify under part 2 of OBAMA AMNESTY and be able to get a work permit valid for three years. He will be able to legalize his status for 3 years and come into the light of the American dream. Hopefully, next year, Congress will enact into law a new path to permanent legal residency and American citizenship.
